Please read these Terms and Conditions ("Terms") carefully before using Fuel Smart AU ("the Service", "the App") operated by Fuel Smart AU ("us", "we", or "our").

1. Acceptance of Terms

By accessing or using Fuel Smart AU, you agree to be bound by these Terms. If you disagree with any part of these Terms, then you may not access the Service.

2. Use of the Service

2.1 Account Requirements

To use certain features of the Service, you may be required to:

• Create an account using Google or Apple Sign-In
• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security of your account credentials
• Accept all responsibility for activities that occur under your account

2.2 Acceptable Use

You agree not to:

• Use the Service for any illegal purpose or in violation of any laws
• Attempt to gain unauthorized access to the Service or its related systems
• Interfere with or disrupt the Service or servers connected to the Service
• Reproduce, duplicate, copy, sell, or exploit any portion of the Service without our express written permission
• Use the Service in any manner that could damage, disable, overburden, or impair the Service

3. Data Accuracy and Reliability

3.1 Fuel Price Data

Fuel price data displayed in the App is sourced from the NSW Fuel Check API provided by the New South Wales Government. While we make every effort to ensure data accuracy:

• Data may not always be reliable: Fuel prices are updated by service stations at various intervals, and there may be delays between price changes at a station and when those changes are reflected in our data.
• Real-time accuracy cannot be guaranteed: Prices shown in the App may differ from actual prices at service stations due to timing delays, technical issues, or updates made by the station after our last data refresh.
• Station information may be outdated: Station locations, availability, and operating hours may change without immediate notice in our system.
• No warranty of accuracy: We do not warrant that the fuel price information is accurate, complete, reliable, current, or error-free.

3.2 Your Responsibility

You acknowledge and agree that:

• You should verify fuel prices directly at the service station before making a purchase decision
• The Service is provided for informational purposes only and should not be your sole basis for purchasing decisions
• You use the Service at your own risk and discretion
• We are not responsible for any losses or damages resulting from reliance on fuel price information displayed in the Service

4. Third-Party Services

4.1 NSW Fuel Check API

Our Service relies on the NSW Fuel Check API for fuel price data. We are not responsible for:

• Any inaccuracies, errors, or omissions in data provided by the NSW Fuel Check API
• Service interruptions or unavailability of the NSW Fuel Check API
• Changes to the NSW Fuel Check API that may affect the availability or accuracy of our Service

4.2 Authentication Services

We use Firebase Authentication (provided by Google) and Apple Sign-In for user authentication. Your use of these services is subject to their respective terms of service and privacy policies.

5. Intellectual Property

The Service and its original content, features, and functionality are owned by Fuel Smart AU and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

6. Limitation of Liability

6.1 Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

• Warranties of merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy, reliability, or completeness of the Service or its content

6.2 Limitation of Damages

To the fullest extent permitted by applicable law, in no event shall Fuel Smart AU, its affiliates, or their respective officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation:

• Loss of profits, data, use, goodwill, or other intangible losses
• Damages resulting from your use of or inability to use the Service
• Damages resulting from any conduct or content of third parties on the Service
• Damages resulting from any reliance on inaccurate fuel price information

7. Indemnification

You agree to indemnify, defend, and hold harmless Fuel Smart AU and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable legal fees, arising out of or in any way connected with:

• Your access to or use of the Service
• Your violation of these Terms
• Your violation of any third-party right, including without limitation any intellectual property right or privacy right

8. Service Modifications and Termination

8.1 Right to Modify

We reserve the right to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice at any time.

8.2 Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of Australia, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.

10. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.

12. Severability

These Terms constitute the entire agreement between you and Fuel Smart AU regarding the use of the Service and supersede all prior agreements and understandings, whether written or oral, relating to the subject matter of these Terms.
